CONSIDERATION OF ACCEPTANCE, REJECTION, AMENDMENT, AND/OR POSTPONEMENT OF EASEMENT E-2021-81, A PERMANENT OFF-SITE UTILITY EASEMENT DONATED BY ASH INVESTMENTS, L.L.C., FOR THE TURTLE CROSSING SECTION 1 ADDITION.

BACKGROUND:  This off-site utility easement is located on the south side of the proposed plat for Turtle Crossing Addition, a Planned Unit Development; which is generally located on the south side of East Lindsey Street approximately 1/2 mile east of 24th Avenue S.E.  On April 10, 2018 Sanitary Sewer off-site easement E-1718-38 serving Stone Lake Addition was approved in the location of the proposed Turtle Crossing Addition.

 

The Final Plat of Turtle Crossing Section 1 Addition has not been filed of record in the Cleveland County Clerk’s office. The final plat will consist of 10.51 acres with 43 residential lots.

 

DISCUSSION: The property owner has submitted donated off-site easements for utilities, including existing sanitary sewer in connection with Turtle Crossing Section 1 Addition.  The utility easements have existing sanitary sewer and lift station to be abandoned as part of subdivision improvements serving the proposed platted properties in Turtle Crossing Addition and be relocated off plat to provide for construction of a sanitary sewer lines in future development. City staff have reviewed the easements as to form.

 

Copies of easements and location map are included in the attached.

 

RECOMMENDATIONBased upon the fact the easements have been donated to the City of Norman for locating the off-site utilities with existing sanitary sewer easement in place and the above information, it is the recommendation of staff that Easement No. E-2021-81 be approved and filed of record with the Cleveland County Clerk.
