CONSIDERATION OF ACCEPTANCE, REJECTION, AMENDMENT, AND/OR POSTPONEMENT OF EASEMENT E-2021-63: A PERMANENT WATER LINE EASEMENT IN THE AMOUNT OF $8,100 FROM MDC COAST 4, L.L.C., FOR THE INTERSTATE DRIVE WATER LINE REPLACEMENT PROJECT.

BACKGROUND:  The restaurants and businesses along Interstate Drive have experienced various line ruptures that were disruptive to their business.  This project will upgrade approximately 8,600 feet of old ductile iron water line with new C-900 PVC water line west of Interstate Drive from Sooner Fashion Mall north to Northwest Blvd, and along Copperfield Drive from Northwest Blvd to Interstate Drive, with an extension west into the Spring Brook Addition.  The contractor will install approximately 3,200 LF of 12-inch, 1,800 LF of 8-inch, and approximately 740 LF of 6-inch by open cut method.  In addition, approximately 1,180 LF of 12-inch and 1,500 LF of 8-inch fusible PVC pipe will be installed by directional boring method.

 

DISCUSSION:  Due to utility conflicts within the existing right-of-way for Interstate Drive, the replacement 12-inch water line alignment was shifted further west into the property for the six restaurants abutting Interstate Drive.  This 15-foot water line easement provides the necessary easement to allow for the installation, operation, and maintenance of the new 12-inch water line.  The easement is located west of Interstate Drive but east of the restaurants generally within the parking lots.

 

This easement overlays an existing gas pipeline easement.  Authorization from the gas company has been received.  MDC Coast 4, LLC has agreed to convey Easement E-2021-63 for the sum of $8,100.  The available balance in Water Distribution System Improvements, Land (Account 31993360-46001; Project WA0245) of $20,000 is sufficient to pay for this easement.

 

RECOMMENDATION: Staff recommends acceptance of Easement E-2021-63 from MDC Coast 4, LLC in the amount of $8,100.
