CHANGE ORDER NO. THREE TO CONTRACT K-1920-46: BY AND BETWEEN THE NORMAN UTILITIES AUTHORITY AND CIMARRON CONSTRUCTION COMPANY, L.L.C., INCREASING THE CONTRACT AMOUNT BY $132,940 FOR A REVISED CONTRACT AMOUNT OF $2,277,439.56 AND ADDING 150 CALENDAR DAYS TO THE CONTRACT FOR THE GRAY STREET AND TONHAWA STREET WATER LINE REPLACEMENT PROJECT.

 

Body

BACKGROUND:  This project will replace approximately 11,500 feet of 6, 8, and 12-inch water line generally along Gray Street and Tonhawa Street and associated side streets from North Base Avenue to Porter Avenue.  The existing water lines are cast iron pipe and were constructed over 50 years ago and have had numerous leaks resulting in significant loss of water and damage to the overlying or adjacent roadway. Repairs to the water line are time consuming for staff and are very disruptive to traffic in the area as repairs are completed. The new water lines will improve water transmission and will be constructed of non-corrosive materials such as polyvinyl chloride (PVC).

 

On April 14, 2015, the Norman Utilities Authority (NUA) approved Contract K-1415-120 with C. H. Guernsey and Company (Guernsey) of Oklahoma City, Oklahoma, in the amount of $39,400, to provide surveying, design, and associated construction services for approximately 3,600 feet of 12-inch and 8-inch water line along Main Street, Flood Avenue, Gray Street and University Boulevard. On June 13, 2017, the NUA approved Amendment No. 1 to Contract K-1415-120 with Guernsey in the amount of $87,200 (total contract of $126,600) to provide surveying, design, and construction services associated for approximately 6,750 feet of 12-inch and 8-inch water line.  On May 28, 2019, the NUA approved Amendment No. 2 to Contract K-1415-120 with Guernsey in the amount of $26,500 (total contract of $153,100) to provide surveying, design, and construction services associated with approximately 1,500 additional feet of water line.

 

On October 25, 2016, the NUA approved CO#2 to Contract K-1516-80 with Central Contracting Services (Central) authorizing replacement of approximately 1,200 feet of deteriorated 12-inch ductile iron pipe water line with 16-inch PVC waterline along the south side of Main Street between Flood Avenue and Park Drive. The work completed under CO#2 with Central Contracting included a portion of the work designed by Guernsey under Contract K-1415-120.

 

For Contract K-1920-46, Change Orders Nos. 1 and 2 were approved on May 11, 2020, and October 9, 2020, respectively.  Change Order No. 1 in the amount of -$24,519.44 authorized the contractor to utilize directional drilling for areas of the project and also added 350 linear feet of pipe for replacement along University Boulevard from Tonhawa Street to Daws Street.  Change Order No. 2 in the amount of $32,054 adjusted the amount of 8 and 12-inch line to be replaced by directional drilling and added new pay items to account for fire services that were identified during the course of the project.

 

DISCUSSION:  Change Order No. 3 is proposed to allow the contractor to replace additional water lines along Porter Avenue outside of the scope of the Porter Acres Intersection project, where the existing water lines are being replaced.  Cimarron Construction Company is the water line replacement contractor for both projects.  However, since the NUA is solely funding the Gray and Tonhawa Street project and the additional length is outside of the scope of the Porter Acres Intersection Project, this change order is proposed under the Gray and Tonhawa Street project.

 

The proposed 570 feet of additional line for replacement is from south of Hughbert Street north to Rich Street.  The current Porter Acres Intersection project ends south of Hughbert Street with a temporary 12-inch water line crossing Porter Avenue.  By extending the project north, this temporary crossing can be utilized at Rich Street and will be a permanent improvement.

 

Also, the Sonic Drive-In located just northeast of the intersection of Frank Street and Porter Avenue has been demolished and is not yet under construction.  By crossing this site now, impacts to the business and its customers will be eliminated.  Lastly, the additional pipe to be replaced under this change order was planned for replacement and is currently under design.

 

The additional 150 calendar days proposed to be added to the contract time are the result of the additional work proposed along Porter Avenue, railroad permitting impacts and significant weather events.  With the additional 150 calendar days, the total project contract time will be 450 calendar days.

 

Sufficient funds are available for this work in Gray and Main Street Water Line Maintenance, Construction (Account 31995521-46101; Project WA0202) with the current available balance at $144,732.95.

 

RECOMMENDATION:  Staff recommends the NUA approve Change Order No. 3 with Cimarron Construction Company, LLC, increasing the contract amount by $132,940 for a revised contract amount of $2,277,439.56 to replace additional pipe from south of Hughbert Street north to Rich Street along Porter Avenue and add 150 additional calendar days to the project.
