BACKGROUND: On December 11, 2018, the NUA approved Contract K-1819-87, pursuant to which Cabbiness Engineering, LLC ("Cabbiness") was retained to provide professional survey, design and engineering services for the City's replacement of approximately 9,700 feet of existing waterline located in the area bounded by Brooks Street to the north, Flood Avenue to the west, Lindsay Street to the south, and Elm Avenue to the east and associated inter-connections and appurtenances. Contract K-1819-87 was amended on November 12, 2019 to include the design, bidding and construction administration for the Parsons Addition Water Line Replacement Project ("Amendment No. 1").

On February 9, 2021, the NUA approved Contract K-2021-96, pursuant to which Cabbiness was retained to provide professional design and engineering services in connection with the NUA's replacement of water lines along the Porter Avenue Streetscape - Phase II, from Robinson Street to Alameda Street.

DISCUSSION: The City of Norman has been informed that Cabbiness Engineering has merged with Garver, LLC, and therefore that Cabbiness seeks to transfer its rights and duties under Contract K-1819-87 (including Amendment No. 1) and K-2021-96 as "Engineer" to Garver, LLC for completion of the referenced projects.

Neither Garver nor Cabbiness seek any amendments to Contracts K-1819-87 or K-2021-96 by reason of this requested assignment.
