ONE TO CONTRACT K-2021-2: BY AND BETWEEN THE CITY OF NORMAN, OKLAHOMA, AND FIRST WATER CONTRACTING, LLC., DECREASING THE CONTRACT AMOUNT BY $16,118.29 FOR A REVISED CONTRACT AMOUNT OF $1,242,624.71, FOR THE URBAN ASPHALT PAVEMENT, PROJECT, FYE 2021 LOCATIONS AND FINAL ACCEPTANCE OF THE PROJECT.

BACKGROUND: In the Norman General Obligation Bond Election of 2016, voters approved the Street Maintenance Bond Program, a 5-year, 4-phase program to address maintenance needs on neighborhood streets. The four categories include (1) Urban Asphalt Street Rehabilitation, (2) Urban Concrete Street Rehabilitation, (3) Urban Road Reconstruction and (4) Rural Road Rehabilitation.  Prior to the election, the City provided a list of all streets included in the program based upon the pavement condition data from the City’s current Pavement Management System. The following is the list of the fiscal year 2020-2021 (FYE 2021) Urban Asphalt Pavement project locations included in this project:

Several Street Maintenance Bond Program Urban Asphalt Street Rehabilitation projects, originally planned for FYE 2021, have previously been completed with other contracts using savings from completed bond projects.  Because these projects have already been completed, staff has included additional streets in this contract, based upon the pavement condition data from the City’s current Pavement Management System.  The following additional Asphalt Pavement project locations are included in this project:

The roadways included in this project are located in established residential neighborhoods.  The current roadways are constructed of asphalt pavement.  The asphalt pavement was in poor condition. This project involves rehabilitation of the existing pavement including milling, deep patching, overlaying with new asphalt, and crack sealing.

 

On July 14, 2020, City Council approved the construction Contract for the Street Maintenance Bond Program - Urban Asphalt Pavement, FYE 2021 Locations Project in the amount of $1,258,743 to First Water Contracting, LLC, of Oklahoma City, Oklahoma.

 

Tonight’s agenda item is for approving Change Order No.1 and Final Acceptance of the Street Maintenance Bond Program - Urban Asphalt Pavement, FYE 2021 Locations Project.

 

DISCUSSIONRoadway construction projects are awarded to the lowest responsible bidder.  Contractor bids are determined using plan quantities multiplied by the contractor’s unit prices for all bid items of the contract.  The total of all of these costs represents the contractor’s bid.  During construction, each quantity is verified in the field and the contractor is to be reimbursed, based on the actual quantity. 

 

Of the thirty (30) bid items, all thirty (30) items had a quantity change.  Seven (7) quantity changes resulted in increased cost, while twenty-three (23) bid items resulted in decreased cost for an overall contract decrease of $16,118.29, or 1.28%.  The contract amount decreased from $1,258,743 to $1,242,624.71 (please see the attached Change Order No.1 for a complete list of bid items cost increases and decreases).  

 

Due to the efficient work of First Water Contracting, LLC, the project was completed approximately two (2) months ahead of schedule.

 

RECOMMENDATION NO. 1:  Staff recommends that Change Order No. 1, decreasing Contract K-2021-2 with First Water Contracting, LLC by $16,118.29 be approved.

 

RECOMMENDATION NO. 2:  Staff further recommends final acceptance of the Street Maintenance Bond Program - Urban Asphalt Pavement, FYE 2021 Locations Project Contract K-2021-2, and final payment to First Water Contracting, LLC in the amount of $62,131.24.
