CONSIDERATION OF ORDINANCE O-1920-35 UPON SECOND AND FINAL READING:  AN ORDINANCE OF THE COUNCIL OF THE CITY OF NORMAN, OKLAHOMA, CLOSING A PORTION OF A WATER LINE EASEMENT LOCATED IN LOT ONE (1), BLOCK ONE (1), OF NORMAN CENTER NORTH ADDITION, NORMAN, CLEVELAND COUNTY, OKLAHOMA; AND PROVIDING FOR THE SEVERABILITY THEREOF.

BACKGROUND:  The final plat for Norman Center North Addition was filed of record on August 4, 2008 in Book 22, Page 7.  This is a request to close a portion of the platted water line easement generally located within Lot 1, Block 1, Norman Center North Addition, located at 2437 West Main Street.

 

DISCUSSION:  The existing water line was installed to serve a fire hydrant.  The applicant has worked with the City Utilities Department regarding the closure.  The proposal is to relocate the existing fire hydrant further south within the existing easement and place it on the existing public water line and declare the existing water line north of the relocated fire hydrant as a private water line system owned and maintained by the applicant Chick-fil-A.  The relocated fire hydrant will provide the required coverage for the Fire Department.  In addition, the structure is served with a fire suppression system.  With the partial closure and vacation of the water line easement, the applicant would be able to construct a canopy on the east side of the existing building covering the drive through lane.  Franchised utilities were not notified based on the fact this is a water line easement serving a City utility.

 

Planning Commission, at its meeting of February 13, 2020, recommended adoption by a vote of 8-0.

 

RECOMMENDATION:  Staff recommends approval of this request to close a portion of a 15’ platted water line easement within Lot 1, Block 1, Norman Center North Addition that interferes with a proposed structure.
