CONSIDERATION OF A RECOMMENDATION FROM THE CITY ATTORNEY THAT THE CITY COUNCIL APPROVE A SETTLEMENT OF JENNIFER SCHMIDT VS. AND THE CITY OF NORMAN, OKLAHOMA, WORKERS’ COMPENSATION COMMISSION CASE CM-2019-02577 K AND GRIEVANCE NO. FYE 2019-SCH IN THE AMOUNT OF $15,000.

BACKGROUND: These cases were brought by Jennifer Schmidt to recover damages alleged to have occurred as a result of an on the job injury and discipline imposed on her for alleged violations of the IAFF Contract. On July 17, 2019, Ms. Schmidt agreed to dismiss her claims with prejudice in exchange for payment in the amount of $15,000. A Release of All Claims and Covenant Not to Sue will also be executed by Ms. Schmidt and her attorney. If Ms. Schmidt’s workers’ compensation claim is settled, the City will incur a dismissal fee of $140. Because this matter involves pending litigation, the merits of these cases were discussed during an Executive Session held on July 23, 2019. The settlement offer is within the range discussed with Council in Executive Session.
Adequate funds to satisfy the proposed settlement are available in the Order/Settlements Account (043-3002-415.21-31).
RECOMMENDATION: It is believed this settlement is fair, reasonable and in the best interest of the City. Accordingly, it is recommended the settlement of this matter be approved by City Council.
