AMENDMENT NO. ONE TO CONTRACT K-1213-170: BY AND BETWEEN THE CITY OF NORMAN, OKLAHOMA AND CP&Y, INC. INCREASING THE CONTRACT AMOUNT BY $193,895 FOR A REVISED CONTRACT AMOUNT OF $897,773.50 TO PROVIDE ADDITIONAL DESIGN SERVICES FOR THE 36th AVENUE NW WIDENING PROJECT BETWEEN TECUMSEH ROAD AND MARKET PLACE.

 

Body

BACKGROUND:  On August 28, 2012, the citizens of Norman voted in favor of a Bond Issue to finance the local share of eight (8) transportation/stormwater improvement projects. One of the eight (8) 2012 bond projects is the 36th Avenue N.W. Widening Project.

 

On November 22, 2011, the Norman City Council approved Programming Resolution R-1112-64, requesting federal funds for the 36th Avenue NW Widening Project. This resolution states the City’s commitment to adhere to the terms and conditions of a federally-funded project including engineering design, acquisition of all necessary rights-of-way and relocation of utilities and encroachments at 100% of the City’s cost.  In return, the Association of Central Oklahoma Governments (ACOG), through the Oklahoma Department of Transportation (ODOT), agrees to provide 80% of the construction cost, estimated at $11,500,000, and administration of the construction with the matching share (20%) from the City of Norman. 

 

On April 9, 2013, City Council approved engineering services Contract K-1213-170 with the engineering firm of CP&Y, Inc. in the amount of $703,878.50, to design the 36th Avenue NW Bond project from Tecumseh Road to Indian Hills Road.

 

On August 14, 2018, City Council approved Resolution R-1819-12 declaring the 36th Avenue NW Project a recoupment project.

 

Proposed improvements for the 36th Avenue NW Widening Project include:

 

                     Widen two miles of roadway from two lanes to four lanes;

                     New traffic signals at 36th Avenue NW and Franklin Road and 36th Avenue NW and Indian Hills Road;

                     Interconnect signals between Tecumseh Road and Indian Hills Road;

                     Dedicated left-turn lanes at All Saints Catholic School;

                     Fifth lane north of Indian Hills Road to Market Place;

                     Stormwater drainage improvements;

                     Continuous sidewalks along both sides of the roadway, with the 10-foot wide Legacy Trail from Tecumseh Road to Franklin Road on the east side;

                     Bicycling facilities as listed in the Norman Bike Plan

 

DISCUSSION:  This proposed Council action is to amend the current contract (K-1213-170) with CP&Y, Inc., increasing the contract amount to accommodate changes in scope of the engineering design from the original contract. 

 

The changes to the design scope of services include:

 

                     Dividing the project into two construction phases to accommodate federal funding limits, which requires increased engineering design, bidding and construction services;

                     Relocation of the proposed roadway alignment to the west, in an effort to eliminate cost-prohibitive electrical transmission line utility relocations;

                     Addition of a new traffic signal to provide necessary traffic operations and pedestrian safety improvements at All Saints Catholic School;

                     Design of necessary City of Norman water and sewer utility relocations

 

CP&Y has proposed a design fee of $193,895 (see Contract Amendment #1) to provide the additional design services for this project.  The original contract with CP&Y for the design was in the amount of $703,878.50.  Funds for the contract amendment are currently available within the budget for the 36th Avenue NW Widening Project and will be paid from the Design account (050-9552-431.62-01; project BP0197).

 

Design of the roadway plans will be complete in December 2019.  Right-of-way acquisition is anticipated to be complete in September 2019 and utility relocations in March 2020.  Construction is scheduled to begin in federal fiscal year 2020-2021 (FFYE 2021) if a grant of federal transportation funds can be acquired through the Association of Central Oklahoma Governments (ACOG).  The total overall project cost is estimated to be $16,920,507.  The current construction estimate is $14,657,840. Federal participation is 80% of construction cost, with a limit of $11,500,000. The City is responsible for right-of-way acquisition, utility relocation and design, totaling $2,262,667. The City’s total share of the project costs, including 20% of construction, is estimated to be $5,420,507.  The City’s share will be paid with bond funds and development fees.  This is approximately 32% of the total estimated project cost.

 

RECOMMENDATION:  Staff recommends approval of Contract Amendment No. One for contract K-1213-170 with CP&Y, Inc., in the amount of $193,895 for the design of the 36th Avenue NW Widening Project between Tecumseh Road and Market Place.
