CERTIFICATE OF PLAT CORRECTION FOR BELLATONA ADDITION, SECTION 1, LOTS 5 & 6, BLOCK 1.

BACKGROUND: The final plat for Bellatona Addition, Section 1, Lots 5 and 6, Block 1, was filed of record March 8, 2016 with the Cleveland County Clerk in Book 24 of Plats, Pages 120 and 121. Since that time, it has been determined that certain scrivener's or draftsman’s errors have been found within the plat. Title 11.0S, 1981, §41-115 permits or provides a method of amending or correcting final plats; subject to the governing body of a City approving such changes.
DISCUSSION: The specific errors relates to a 7.5’ drainage easement on the south side of Lot 5 and a 7.5’ drainage easement on the north side of Lot 6, Block 1 of the plat. It impacts only these lots within the plat. The surveyor inadvertently transferred the easements from a preliminary plat. With a redesign of the drainage with the construction plans submitted with the final plat the easements were not needed and there are no drainage structures within the easements.
RECOMMENDATION: Staff is not opposed to the changes, and since a procedure has been established without the requirement for District Court action, Staff recommends City Council approval of Certificate of Plat Correction CPC-1819-2 for the above-mentioned addition.
