RESOLUTION R-1819-74: A RESOLUTION OF THE COUNCIL OF THE CITY OF NORMAN, OKLAHOMA, DONATING USED BODY ARMOR AND OTHER SURPLUS EQUIPMENT TO THE JONES, OKLAHOMA, POLICE DEPARTMENT.

BACKGROUND: The Norman Police Department provides body armor to every commissioned police officer, which is replaced every five years based on industry recommendations and union contract. The used body armor is generally destroyed or used for ballistic testing; it cannot be resold/returned.
DISCUSSION: Recently, there have been requests from the Jones, Oklahoma, Police Department to donate any used body armor and other surplus equipment. After some evaluation, Jones Police Department would re-issue any of the items that had working life left to law enforcement officers who cannot afford to purchase them. Section 8-301 of the Code of the City of Norman provides that “The City Council must declare surplus or obsolete any supplies, material, or equipment where the valuation exceeds one thousand dollars ($1000) prior to the selling of such supplies, material, or equipment.” Section 8-302 says that all sales of surplus or obsolete supplies, materials and equipment must be made through competitive bidding at public auction unless the Council chooses by resolution to donate the supplies, material or equipment to other cities or non-profit agencies.
The Norman Police Department currently has thirteen (13) used sets of body armor to donate. The current value for the used body armor is approximately $100-$200 each, or $1300-$2600 for all thirteen sets. We also have four (4) taser holsters, five (5) pistol holsters, nineteen (19) pepper spray pouches, eighteen (18) handcuff cases, four (4) flashlight loops, twenty (20) magazine pouches, four (4) batons w/ holders, one (1) radio case, seven (7) over belts, eight (8) under belts and eighty six (86 ) keepers. The value of these items is estimated at two or three hundred dollars ($200-$300). These items are all used; none are eligible for return to the vendor.
A “Liability Waiver” form will be signed by a representative of the agency upon receipt.
RECOMMENDATION: It is recommended the equipment listed above be declared surplus and that Resolution R-1819-84 authorizing the donation thereof to the Jones Police Department.
