CONSIDERATION OF ORDINANCE O-1819-21 UPON SECOND AND FINAL READING:  AN ORDINANCE OF THE COUNCIL OF THE CITY OF NORMAN, OKLAHOMA, CLOSING A PORTION OF A UTILITY EASEMENT LOCATED ON LOT 1, BLOCK 2, GRANDVIEW ESTATES NORTH ADDITION NO. 2, NORMAN, CLEVELAND COUNTY, OKLAHOMA; AND PROVIDING FOR THE SEVERABILITY THEREOF. 

 

Body

BACKGROUND:  The plat for Grandview Estates North Addition No. 2 was filed of record on February 6, 1976 in Book 11, Page 105.  The owner is interested in closing and vacating a portion of a thirty-foot (30’) utility easement within Lot 1, Block 2 of Grandview Estates North Addition No. 2 in order to expand a storage building.

 

At this time, there is only one utility company utilizing the easement.  The owner has worked with Oklahoma Electric Cooperative (OEC) to satisfy their needs and move toward closing a portion of the easement.  OEC has not objected to the request.  The closure consists of 15’ in width for a majority of the easement and 20’ in the area of the expansion of an existing building.

 

DISCUSSION:  All franchise utilities were notified to assess the impact on their facilities if a portion of the easement was closed; there were no objections.  The utility companies and City staff are not opposed to the partial closure of a thirty-foot (30’) utility easement.  City Council, at its meeting of February 22, 2011 adopted Ordinance O-1011-45 closing the public access portion of the easement throughout the Grandview Estates North Developments.

 

RECOMMENDATION:  Staff recommends approval of the request to close a portion of a thirty-foot (30’) utility easement located within Lot 1, Block 2, Grandview Estates North Addition No. 2.
