EASEMENT E-1819-28:  A PERMANENT DRAINAGE EASEMENT DONATED BY FOY COX FOR THE LAKEHURST STORMWATER DRAINAGE PROJECT.

BACKGROUND:  Over the past several years, residents along Lakehurst Drive in the Oakhurst Addition have experienced flooding and property damage due to stormwater overflows in the street.  Staff has worked closely with the residents to evaluate the problem and to develop a solution.  City staff currently uses an agreement for On-Call Engineering Services with Cardinal Engineering (Contract K-0910-62) to do various small design/engineering projects.  On September 25, 2017, Cardinal Engineering was authorized to prepare a final design and easement documents for this project at a cost of $10,300.  In order to adequately address the flooding in this area, it is necessary to install a new 36-inch stormwater pipe between 1802 and 1806 Lakehurst Drive.  In order to install public stormwater infrastructure of this nature, a permanent drainage easement is necessary for the property located at 1806 Lakehurst Drive.  The property owners have donated a public drainage easement for the stormwater infrastructure that will be located between 1802 and 1806 Lakehurst Drive.  

 

If Council accepts the easement, a bid opening for the stormwater pipeline construction will take place on Thursday, November 8, 2018.  Construction of these improvements is anticipated to begin in December 2018, weather permitting.

 

DISCUSSION:  City staff prepared an easement for the previously mentioned parcel of land and requested the owner (Mr. Foy Cox) to consider donating it to the City.  Mr. Cox has agreed to donate the public drainage easement to the City.  The City Attorney’s Office has reviewed the easement as to form.

 

RECOMMENDATION:  Based upon the above information, it is the recommendation of staff that Easement E-1819-28 be approved.
