CONSIDERATION OF AWARDING OF BID 1819-7, APPROVAL OF CONTRACT K-1819-9 WITH MTZ CONSTRUCTION, INC., IN THE AMOUNT OF $82,464; PERFORMANCE BOND B-1819-13, STATUTORY BOND B-1819-14, AND MAINTENANCE BOND MB-1819-7 FOR THE BURLINGTON DRIVE DRAINAGE IMPROVEMENTS PROJECT AND RESOLUTION R-1819-9 GRANTING TAX EXEMPT STATUS.

BACKGROUND: In response to multiple citizen complaints regarding inadequate drainage and safety concerns along Burlington Drive over several years, the City’s fiscal year 2018-2019 (FYE 2019) Capital Fund includes a project to address the problem. In 2017, Public Works Stormwater Division began working with Cardinal Engineering to design improvements to the stormwater system along this street to prevent stormwater from ponding along the gutter or surfacing through cracks and joints in the street. Based on Cardinal’s analysis, it was determined that the installation of a perforated pipe beneath the curb and gutter along both sides of Burlington Drive from 3621/3620 Burlington Drive to 1501 Pembrooke Drive connected to the stormwater pipe near 36th Ave NW on Burlington Drive was the most cost-effective way to address the drainage and safety concerns reported by the citizens.
DISCUSSION: In order to complete this project in a timely manner, it is necessary to use private contracting services. On August 23, 2017, using the Agreement for On-Call Engineering Services between City of Norman/Norman Utilities Authority and Cardinal Engineering, Contract K-0910-62, Cardinal Engineering was authorized in the amount of $16,000 to prepare a final design and bid documents for this project.
The bid opening was conducted on August 30, 2018, and three (3) contractors submitted bids. The Engineer’s Estimate is $81,000. The lowest bid in the amount of $82,464, submitted by MTZ Construction, Inc., is $1,464.00 (1.8% percent) above the estimate. If approved, construction will begin on this project in October 2018 and will be completed by February 2018.
If approved, funding for Contract K-1819-9 in the amount of $82,464 is available in the FYE 2019 Capital Fund, Drainage Projects, Construction (account 050-9968-431.61-01; project DR0057). This project is an ongoing annual Capital Budget Stormwater program to address smaller stormwater drainage problems around the City as they are discovered, which includes projects such as this.
RECOMMENDATION 1: Staff has reviewed the bids and recommends that Bid 1819-7 for the Burlington Drive Drainage Improvements project, be awarded to the low bidder, MTZ Construction, Inc., in the amount of $82,464.
RECOMMENDATION 2: Staff further recommends that the following contract and bonds be approved:

Statutory Bond B-1819-14
Maintenance Bond MB-1819-7
RECOMMENDATION 3: Staff further recommends that Resolution R-1819-9 be adopted authorizing MTZ Construction, Inc., as project agent to avoid the payment of sales tax on the purchase of materials for the project.
