ONE TO CONTRACT K-1516-121: BY AND BETWEEN THE CITY OF NORMAN, OKLAHOMA, AND SILVER STAR CONSTRUCTION COMPANY, INC., DECREASING THE CONTRACT AMOUNT BY $367,248.79 FOR A REVISED CONTRACT AMOUNT OF $1,312,746.21, FOR THE URBAN ASPHALT PAVEMENT REHABILITATION CAPITAL IMPROVEMENT PROJECT, 2015-2016 LOCATIONS, AND FINAL ACCEPTANCE OF THE PROJECT.

 

Body

BACKGROUND: The City of Norman funds a portion of its annual street repairs through the City’s Capital Improvement Program, the Street Maintenance Bond Program and the City’s General Fund.  The Street Capital Improvement Program identifies seven programs that address the means and methods of performing preventative maintenance on public infrastructure.  The seven categories are as follows:

 

                     Crack Seal Program

                     Alley Repair Program

                     Valley Gutter Program

                     Asphalt Pavement Maintenance Program

                     Asphalt Paver Patching Program

                     Rural Road Improvements Program

                     Concrete Pavement Maintenance Program

 

Repairs under the Street Maintenance Capital Improvement Program are made by both City of Norman employees and qualified paving contractors.  In an effort to get caught up in the Street Capital Improvement Program, street maintenance projects identified in FYE 2012, 2014 and 2016 programs were advertised for bid.  On May 24th, 2016, the City Council awarded the FYE 2014 and FYE 2016 Asphalt Pavement Maintenance Projects and the FYE 2012 Asphalt Paver Patching Project to Silver Star Construction of Moore, Oklahoma in the amount of $1,679,995.00.  The projects involved full-depth base repairs for subgrade failures, milling 2 inches of the existing surface and applying 2 inches of hot mix asphalt.

 

DISCUSSION: The locations included in this contract were:

 

                     BP0249 Robinson Street: 24th Avenue NE to 60th Avenue NE (3.0 Miles)

                     SC0557 Robinson Street: 24th Avenue NE to 60th Avenue NE (3.0 Miles)

                     SC0558 North Base Paving (0.6 Miles)

                     SC0583 Peters Avenue: Grey Street to Eufuala Street (0.2 Miles)

                     SC0584 Comanche Street: Jones Avenue to Peters Avenue (0.1 Miles)

                     SC0524 Ed Noble Parkway: Main Street to Lindsey Street (1.2 Miles)

                     SC0525 Norman Center Court: 200-300 Block (0.2 Miles)

                     SC0526 William Pereira: 3000 Block (0.1 Miles)

 

All work was completed per the contract specifications. Final quantities and costs for the project are detailed in the Change Order Summary. Change Order No. 1, which reflects all measured quantities of completed work, decreases the total contract amount by $367,248.79 or 22% of the previously estimated quantities.  The large decrease was attributed to anticipated costs for additional pavement repair due to the water line relocation by the NUA.  The additional costs were accounted for through a transfer of funds from BP0249 of the 2010 Street Maintenance Bond Program. Once this contract was awarded, NUA repaired and funded the additional pavement repairs.  If Change Order No. 1 is approved, the final total cost of this project is $1,312,746.21. In addition, if Change Order No. 1 is approved, the surplus funds will be retained in the fund balance of the 2010 Street Maintenance Bond Program.  Silver Star Construction completed all work on September 30, 2017.

 

RECOMMENDATION NO. 1: Staff recommends approval of Change Order No. 1 (final) decreasing the contract by $367,248.79.  If approved, the total contract amount with Silver Star Construction will decrease to $1,312,746.21 from $1,679,995.00, a decrease of 22%.  If approved, the $367,248.79 will be retained in the fund balance of the 2010 Street Maintenance Bond Program.

 

RECOMMENDATION NO. 2: Staff recommends final acceptance of the FYE 2014 and FYE 2016 Asphalt Pavement Maintenance Program and the FYE 2012 Asphalt Pavement Patching Program, Contract K-1516-121, and further recommends that final payment in the amount of $65,637.31 be directed to Silver Star Construction of Moore, OK.
