EASEMENT E-1718-40: CONSIDERATION OF ACCEPTANCE OF A PERMANENT UTILITY EASEMENT DONATED BY RIEGER, L.L.C. FOR RIEGER-THOMPSON DRIVE.

BACKGROUND: This property was developed prior to the requirement for commercial properties to be platted. The owner’s proposal is for the expansion of an existing structure. It has been determined a short form plat could be utilized to fulfill platting requirements; however, the surveyor for the owner was unable to determine if the existing utilities located in the rear of the property were covered by an existing utility easement. It was agreed by the owner that he would dedicate a public utility easement during the platting process.
DISCUSSION: The property is owned by Rieger L.L.C. Existing public utilities were installed to serve the existing structures in the area. The utility easement has been donated by the owners as part of the Short Form Platting process. The City Attorney’s Office has reviewed the easement as to form.
RECOMMENDATION: Based upon the above information, it is the recommendation of staff that Easement E-1718-40 for a utility easement be approved.
