CONSIDERATION OF AWARDING BID 1718-28; APPROVAL OF CONTRACT K-1718-73 BY AND BETWEEN THE CITY OF NORMAN, OKLAHOMA, THE NORMAN MUNICIPAL AUTHORITY, THE NORMAN UTILITIES AUTHORITY, AND SILVER STAR CONSTRUCTION COMPANY, INC., IN THE AMOUNT OF $1,867,880 AND RESOLUTION R-1718-52 GRANTING TAX EXEMPT STATUS FOR THE JAMES GARNER AVENUE PHASE 1 PROJECT.

BACKGROUND:  On November 2, 2015, City Council approved contract K-1516-83 with Meyer, Scherer & Rockcastle, Ltd. (MSR) for architectural services for the design of the new Central Library approved as part of NORMAN FORWARD. The Central Library will be located north of the intersection of Acres Street and James Garner Avenue. Additionally, the approval of NORMAN FORWARD included the construction of James Garner Avenue from Acres Street to Flood Avenue.

 

On June 14, 2016 City Council approved Amendment No. One to Contract K-1516-83 with MSR for the design of Phase I of the James Garner Project, increasing the contract amount by $64,900 for a revised contract amount of $3,750,710.

 

The James Garner Avenue Phase I project will construct the extension of James Garner Avenue along the east side of the new Library, which will serve as a fire lane for the Library.  The project also re-aligns the intersection of Acres Street west of the existing intersection at James Garner Avenue, so a concrete safety barrier can be installed between the new intersection and the BNSF Railroad Crossing, improving the safety of this railroad crossing and to be in compliance with Railroad Quiet Zone standards. The intersection improvements include new left turn lanes from Acres Avenue onto James Garner Avenue.  Stormwater drainage system improvements will utilize a Low Impact Development (LID) design, where depressed medians and landscaping will facilitate rainwater to naturally filter and seep back into the ground by means of a bio-swale.

 

DISCUSSION:  Bid documents and specifications for construction of James Garner Phase I, including reconstruction of Acres Street and James Garner intersection were advertised according to State Law on December 28, 2017 and January 4, 2018.  Five (5) potential bidders acquired plans and specifications and five (5) bids were received on January 18, 2018.

 

The low bidder is Silver Star Construction in the amount of $1,867,880, which is $18,522.85 less than the next lowest bidder.  The Engineer’s estimate for the project is $1,900,454.80. 

 

The project represents a culmination of several types of infrastructure improvements, including railroad safety, roadway alignment and water line upgrades.  Although the project is primarily funded as a Norman Municipal Authority project using funds from the NMA Sales Tax Notes, Series 2015B, Norman Forward Bond project, the Norman Utility Authority and the Railroad Quiet Zone Capital Fund also provided funding representative of their improvements.  Funding sources for the project are attached.

 

If approved, construction will begin on March 15, 2018.  The project will be completed by November 30, 2018. It is important that this infrastructure project be completed before the new Central Library is opened, which is currently anticipated by July of 2019.

 

RECOMMENDATION NO. 1Staff and our consultant have reviewed the bids and recommend that Bid 1718-28 for James Garner Phase I be awarded to the low bidder, Silver Star Construction, Inc., of Moore, Oklahoma for the amount of $1,867,880.

 

RECOMMENDATION  NO. 2:  Staff further recommends that Contract K-1718-73 be approved and the Mayor be authorized to sign Performance Bond B-1718-42, Statutory Bond B-1718-43 and Maintenance Bond MB-1718-27 contingent upon the City Attorney’s approval.

 

RECOMMENDATION  NO. 3:  Staff further recommends that, upon approval of Bid 1718-28, Silver Star Construction be authorized and appointed as project agent via Resolution R-1718-52.
