SPECIAL CLAIM SC-1718-15:  SUBMITTED BY DYLAN JOHNSON IN THE AMOUNT OF $3,611.17 FOR VEHICLE DAMAGE THAT OCCURRED AS A RESULT OF A COLLISION WITH A CITY SANITATION TRUCK AT 329 SHERWOOD DRIVE.

BACKGROUNDA claim was filed by Dylan Johnson in the amount of $3,611.17 for damage his van received when it was struck by a City sanitation vehicle in front of his home on 629 Sherwood Drive.

 

DISCUSSIONThis incident was investigated by Terry Richmond, Utilities Supervisor.  On October 19, 2017, a City employee was driving a sanitation truck northbound on Sherwood Drive when he tried to maneuver past two vehicles that were legally parked along the curb on opposite sides of the street.  The employee misjudged the distance needed to successfully pass the vehicles and subsequently struck Mr. Johnson’s van parked along the curb.

 

Mr. Johnson owns a 1991 GMC Vandura G2500 van in “Good” condition and according to the NADA Guides Value Report is worth $4,200 average retail.  Mr. Johnson has submitted three (3) estimates to repair the left rear side panel, tail lamp and bumper of his van, with the lowest estimate being $3,611.17. 

 

As indicated above, there appears to be possible negligence on the part of the City in this matter and consequently potential liability on the City.  Mr. Johnson’s claim, in the amount of $3,611.17 for the value of the van, appears reasonable.

 

RECOMMENDATIONBased upon the above and foregoing, it is the recommendation of the City Attorney’s office that the claim of Dylan Johnson, in the amount of $3,611.17 as set forth above, be approved.
