EASEMENT E-1718-46:  CONSIDERATION OF ACCEPTANCE OF A PERMANENT RIGHT-OF-WAY EASEMENT DONATED BY MR. MIKE MILLIGAN TO SERVE THE ROCK CREEK ROAD WIDENING AND SIGNALIZATION PROJECT.

BACKGROUND: On August 25, 2015, City Council approved Contract K-1516-7, for a fee of $184,379.70, with White Hawk Engineering and Design to provide design services for a widening and signalization project on Rock Creek Road (from just west of 12th Avenue NW to just east of Trailwood Drive). That project, which has an estimated cost of $2.95 M, will install traffic signals at the Rock Creek Road/12th Avenue NW and the Rock Creek Road/Trailwood Drive intersections. Roadway modifications to Rock Creek Road will include widening of the existing four-lane section at these intersections to accommodate left turn lanes, widening of the narrow four lane section between the two signals to meet current standards, and drainage improvements. Also, the existing two-lane section on 12th Avenue NW will be widened to five lanes (including  southbound left turn lane plus bicycle lanes), sidewalks will be constructed/replaced as needed, and fiber optic traffic signal interconnection of the traffic signals along Rock Creek Road from Flood Avenue to Porter Avenue will be installed.

 

On September 13, 2016, City Council approved Amendment No.1 to Contract K-1516-7 for design services by White Hawk Engineering & Design in the amount of $34,288.45 to cover expenses associated with the relocation and upsizing of the waterline along this portion of Rock Creek Road. On November 28, 2017, Central Contracting, Inc. of Norman was awarded Contract K-1718-68 in the amount of $598,244.00 to provide construction services for the waterline.

 

To accommodate the portion of the construction along 12th Avenue NW, the City needs to utilize the 120 feet of public right-of-way usually reserved at intersecting arterial streets. This reservation of right-of-way typically happens during the platting process, but has not yet occurred at this location because the adjacent lots on either side of 12th Avenue NW are not platted.  This item asks Council to accept a permanent right of way easement from the property owner to be able to move forward with this project.

 

DISCUSSIONStaff met with the owner of the property along the west side of 12th Avenue NW (Mr. Mike Milligan) to discuss the potential dedication of right-of-way in advance of platting. Mr. Milligan agreed to advance the dedication of this right-of-way at no cost to the City.

 

The availability of this right-of-way (Easement E-1718-46) will allow the City to place the new water line, currently under construction, in an area better suited for future maintenance. The similar dedication of right-of-way on the east side of 12th Avenue NW, and other easements needed for the construction of the widening and signalization project, will not impact the water line construction, and will occur at a later date.

 

RECOMMENDATION: Staff recommends acceptance of Easement E-1718-46.
