AMENDMENT NO. ONE TO CONTRACT K-1213-169: BY AND BETWEEN THE CITY OF NORMAN, OKLAHOMA, AND ATKINS NORTH AMERICA INCREASING THE CONTRACT AMOUNT BY $133,455 FOR A REVISED CONTRACT AMOUNT OF $1,008,721.50 TO PROVIDE ADDITIONAL ENGINEERING DESIGN SERVICES FOR THE 24TH AVENUE EAST IMPROVEMENT PROJECT FROM LINDSEY STREET TO ROBINSON STREET AND BUDGET TRANSFER BETWEEN PROJECT ACCOUNTS.

 

Body

BACKGROUND:  On November 22, 2011, the Norman City Council approved Programming Resolution R-1112-62 requesting federal funds for the 24th Avenue East Widening Project. This resolution states the City’s commitment to adhere to the terms and conditions of a federally funded project including engineering design, acquisition of all necessary rights-of-way and relocation of utilities and encroachments at 100% the City’s cost.  In return, the Association of Central Oklahoma Governments (ACOG), through the Oklahoma Department of Transportation (ODOT), agrees to provide Federal Highway Administration funding for 80% of the construction cost, estimated at $9,221,000, and administration of the construction with the matching share (20%) from the City of Norman. 

 

On August 28, 2012, the citizens of Norman voted in favor of a General Obligation Bond Issue to finance the local share of eight transportation/stormwater improvement projects. One of the eight 2012 bond projects is the 24th Avenue East Widening Project (please see the attached location map showing the project boundaries).  The total estimated project cost including design, utility relocations, right-of-way, construction and construction management is $13,008,000.  The City’s share is $5,177,000.

 

Proposed improvements for the 24th Avenue East Widening Project include:

 

1.                     Widen two miles of roadway from two lanes to four lanes;

2.                     New traffic signal at 24th Avenue East and Meadowood Boulevard;

3.                     Intersection improvements at 24th Avenue East/Meadowood Boulevard and 24th Avenue East/Robinson Street;

4.                     Interconnect traffic signals on 24th Avenue East from Lindsey Street to Robinson Street;

5.                     Continuous sidewalks and accessibility improvements;

6.                     Stormwater drainage improvements;

7.                     On-street bike lanes

 

On March 12, 2013, City Council approved engineering services Contract K-1213-169 with Atkins North America, Inc. for the design of the 24th Avenue East Widening Project between Lindsey Street and Robinson Street in the amount of $875,266.50.

 

On January 23, 2018, City Council approved Contract K-1718-63 in the amount of $45,413 with Oklahoma Natural Gas (ONG) for Phase 1 (Lindsey to Alameda) utility relocations within private easements.

 

On January 23, 2018, City Council approved the allocation of $74,200 for property acquisition services under On-Call Contract K-1314-103 with Pinnacle Consulting Management Group.

 

DISCUSSION:  This agenda item is an amendment to Contract K-1213-169 with Atkins to address several additional engineering services on the 24th Avenue East Widening Project.  Explanations are provided below for the major design items. A complete list of design items and associated costs are included in the attached amendment.

 

Many of the items are related to separating the project into two phases, with Phase 1 being 24th Avenue SE from Lindsey Street to Alameda Street (1 mile); and Phase 2 being 24th Avenue NE from Alameda Street to north of Robinson Street (1 mile).  ACOG funding rules have changed since this original contract was approved with Atkins and now the maximum federal funds any one project can receive is $7.5 million.  As a result, staff has elected to split the project in half to maximize federal funds and to have the ability to place these projects in different fiscal years, again to maximize available funds.

 

Design Changes:

Beaumont Drive intersection design changes were necessary to avoid taking additional right-of-way and impacting one home enough that it would need to be acquired.  Robinson Street intersection changes were necessary to meet the City’s recently-adopted standards included in the Norman Comprehensive Transportation Plan (CTP).

 

Phase 1 water line utility conflicts have recently been identified so the Phase 1 water line relocation plans have been incorporated into this contract amendment.  The Phase 2 water line relocation plans contract amendment will be brought to Council at a later date, once all conflicts have been identified and the scope can be finalized.

 

Funding for this contract amendment will require a transfer in the amount of $133,455 from the 24th Avenue East Widening Bond Project, Utilities (account 050-9552-431.67-01; project BP0192), to the 24th Avenue East Widening Bond Project, Design (account 050-9552-431.62-01; project BP0192).  The above-mentioned Utilities account currently has a balance of $2,059,987. 

 

RECOMMENDATION:  Staff recommends approval of Amendment No. 1 to Contract K-1213-169 with Atkins North America for additional design-related items on the 24th Avenue East Project in the amount of $133,455 and transfer $133,455 from the 24th Avenue East Widening Bond Project, Utilities (050-9552-431.67-01; project BP0192), to the 24th Avenue East Widening Bond Project, Design (050-9552-431.62-01; project BP0192).
