(GENERALLY LOCATED ON THE EAST SIDE OF 36TH AVENUE S.E. AND ONE-HALF MILE SOUTH OF HIGHWAY NO. 9)

BACKGROUND: This item is Norman Rural Certificate of Survey COS-1920-2 for John Daniel Acres, generally located on the east side of 36th Avenue S.E. and one-half mile south of State Highway No. 9. The property is located in the A-2, rural agricultural zoning district.

Planning Commission, on May 14, 2020, recommended, on a vote of 8-0, to City Council that Norman Rural Certificate of Survey COS-1920-2 for John Daniel Acres be denied, with a variance in the width of a private road serving three tracts from 20-feet to 12-feet and a variance in the WQPZ (Water Quality Protection Zone) due to substantial hardship or inequity.

DISCUSSION: There are a total of three (3) tracts encompassing 37.68 acres in this certificate of survey. Tracts 1 and 2 consist of 10 acres each and Tract 3 consists of 17.68 acres. This certificate of survey, if approved, will allow one single family main structure on each tract. There are existing structures on Tracts 1 and 2.

There is a proposed private road to serve the tracts. The private road will be built to the standards as adopted by City Council. There is a provision in the subdivision regulations that if no more than four (4) lots or tracts are served by a private road a reduction in width of the road could be requested. A request has been made to reduce the width of the private road from 20-feet to 12-feet.

A private individual sanitary sewer system and water system will be installed in accordance with the Oklahoma Department of Environmental Quality (ODEQ) standards. There are existing systems on Tracts 1 and 2. Fire protection will be provided by the City of Norman pumper/tanker truc...
