EASEMENT E-1617-9: CONSIDERATION OF ACCEPTANCE OF A PERMANENT UTILITY EASEMENT DONATED BY JPHM INVESTMENT, L.L.C FOR PROPERTY OWNED BY METRO SHOES WAREHOUSE LOCATED AT 2300 24TH AVENUE N.W. (LOT 6A, BLOCK 1, UNIVERSITY NORTH PARK ADDITION, SECTION VI)

BACKGROUND: Metro Shoes (2300 24th Avenue N.W.) consisting of 2 of the 4 tenant spaces at 2300 24th Avenue N.W. has been built on Lot 6A, Block 1, University North Park Addition, Section VI. This lot was originally platted as Lots 5 and 6, Block 1 University North Park Addition, Section VI and filed of record at the Cleveland County Clerk on July 30, 2008; however, Lots 5 & 6 were adjusted per Lot Line Adjustment #1539 on January 4, 2016 and Lot 6A was created to replace the former Lots 5 & 6, Block 1. The property is approximately 1.91 acres and consists of one commercial lot which is located 365 feet south of Rock Creek Road along the west side of 24th Avenue NW. The property owners have submitted an easement E-1617-9 for a water line located on the referenced parcel.
DISCUSSION: Public water system improvements were installed as part of the development on Lot 6A for the new commercial tenant spaces built at 2300 24th Avenue N.W. As a result, an additional easement is needed for the above mentioned utility. The easement has been donated by the owners. The City Attorney’s Office has reviewed the easement as to form.
RECOMMENDATION: Based upon the above information, it is recommended that Easement E-1717-9 be accepted by Council.
