AMENDMENT NO. THREE TO CONTRACT NO. K-0809-45: BY AND BETWEEN THE CITY OF NORMAN, OKLAHOMA, AND NEXTEL WEST CORPORATION TO REPLACE FAILED EQUIPMENT AS PART OF THE FREQUENCY CONFIGURATION AGREEMENT FOR THE 800 MEGAHERTZ (MHZ) COMMUNICATION SYSTEM AT NO COST TO THE CITY OF NORMAN.

BACKGROUND: Nextel West Corporation is under order from the Federal Communications Commission (FCC) to stop interference within the 800 MHz radio band. This process is being funded entirely by Nextel West Corporation. Contract No. K-0809-45 was approved by City Council on December 23, 2008, and was executed by Nextel West Corporation on January 21, 2009. Since execution of the contract, City staff and contractors deployed various radios to both internal City users and external users that operate under our FCC license(s). Amendment No. One (1) to the contract was approved by City Council on August 25, 2009, which added 25 additional replacement radios along with labor and materials. On September 13, 2011, City Council approved Amendment No. Two (2) which added 151 additional replacement radios, the tuning of a mutual aid repeater and additional labor and materials.
DESCRIPTION: During the re-banding process, the mutual aid repeater could not be retuned as outlined in the initial contract. Nextel West Corporation is obligated by the FCC to ensure that all necessary equipment is retuned as ordered. The FCC order is to replace any and all equipment that cannot be re-tuned. The replacement of equipment must be like in operation and functionality and cannot include any feature which can be interpreted as an “upgrade”. Nextel West Corporation and the City have negotiated the replacement of the mutual aid repeater with like equipment listed in Amendment No. Three (3) . This replacement has a value of $1500 not including installation and miscellaneous hardware at no cost to the City of Norman.
