BACKGROUNDOn November 29, 2017, the City of Norman, Norman Animal Welfare Center, received a notice from the Dimery Law Offices in Norman, Oklahoma, advising the City of Norman Animal Welfare Center had been designated as a charitable organization in the Estate of James Freeman.  The City of Norman Animal Welfare Center is the recipient of $77,252.45 from the Estate of James Freeman “for use in a program to allow animals to be adopted out of the shelter.”

 

DISCUSSION  Mr. Freeman died on July 16, 2016, a resident of Cleveland County, Oklahoma.  He died a single person and did not have any children.  He executed a valid Last Will and Testament on May 12, 2014.  A probate of his estate was filed on September 1, 2016, by the Dimery Law Offices in Norman, Oklahoma. The Cleveland County District Court appointed Martha Henderson as Personal Representative of his estate.

 

Section 3.01-Tangible Personal Property of Mr. Freeman’s Last Will and Testament gave the balance of his 401K at the time of his death to the Norman Animal Welfare Center (Norman Animal Welfare Department), in his name, “for the use in a program to allow animals to be adopted out of the shelter.”

 

An Order for Partial Distribution was filed in the Cleveland County District Court authorizing the Personal Representative to make a partial distribution, in cash, to the Norman Animal Welfare Center in the amount of $77,252.45.

 

RECOMMENDATIONBased upon the above, it is recommended by the Norman Police Department that the City Council authorize execution of the Receipt and Release and authorize the Finance Director to deposit the contribution funds in Other Revenue/Animal Control (account 010-0000-227.24.31) for use by the Norman Animal Welfare Center.
