BACKGROUND: The final plat for Woodcrest Estates Plaza Addition was filed of record with the Cleveland County Clerk on March 25, 1970. The property consists of .98 acres and is located at the northeast corner of Porter Avenue and Woodcrest Drive. The property has remained vacant since the filing of the final plat until the City Council, at its meeting of January 22, 2013, adopted Ordinance No. O-1213-24 placing this property in C-1, Local Commercial, and removing it from RM-6, Medium Density Apartment District. The owners, Norman DOP VIII, LLC, submitted a building permit application on February 28, 2013 to construct a Dollar General Store on the  property. With a survey of the property, it was determined an existing sanitary sewer main was located outside of an existing platted utility easement.
 
DISCUSSION:  Based upon the fact there is a need for sanitary sewer service within the development and the developer/owner is willing to provide the additional sanitary sewer easement, staff recommends acceptance of Easement No. E-1314-20.  
 
RECOMMENDATION: Staff recommends that Easement No. E-1314-20 be accepted and the filing thereof be directed.
