EASEMENT E-1718-63: CONSIDERATION OF ACCEPTANCE OF A PERMANENT SIDEWALK EASEMENT DONATED BY 24TH AVENUE APARTMENTS, L.L.C., FOR UNIVERSITY NORTH PARK SECTION XIV, LOT 1, BLOCK 1, A PLANNED UNIT DEVELOPMENT.

BACKGROUND: The final plat for University North Park Professional Center, a Planned Unit Development (PUD) was filed of record with the Cleveland County Clerk on October 29, 2015. The property is located one fourth mile north of Rock Creek Road on the east side of 24th Avenue N.W. The property is occupied by a new apartment building. With the recent installation of a ten-foot wide sidewalk, a portion of the sidewalk is located outside the public right-of-way. The property owners have donated a public sidewalk easement for the sidewalk that is located outside of the public right-of-way.
DISCUSSION: Public sidewalk improvements have been installed as part of the commercial lot. To meet the sidewalk design and width, a portion of the public sidewalk was placed on private property. The City Attorney’s Office has reviewed the easement as to form.
RECOMMENDATION: Based upon the above information, it is the recommendation of staff that Easement E-1718-63 be approved.
