CHANGE ORDER NO. ONE TO CONTRACT NO. K-1213-29: BY AND BETWEEN THE CITY OF NORMAN, OKLAHOMA, AND CGC, L.L.C., DECREASING THE CONTRACT AMOUNT BY $1,701.30 FOR A REVISED CONTRACT AMOUNT OF $676,668.02 FOR THE 24TH AVENUE N.W. AND LEGACY PARK DRIVE TRAFFIC SIGNAL AND INTERSECTION IMPROVEMENT PROJECT AND FINAL ACCEPTANCE OF THE PROJECT.

BACKGROUND: The University North Park (UNP) Tax Increment Finance District (TIF) was established in July 2006 with plans to provide public financial assistance to the development of the area along 24th Avenue N.W. between Robinson Street and Tecumseh Road. Up to $54,725,000 of TIF sales and property tax apportionment revenues are authorized for public improvements, of which $11,550,000 is authorized for Traffic and Roadway Improvements. Some of the improvements include a frontage road extending north from Robinson Street and improvements to up to five intersections along 24th Avenue NW.
The intersection of 24th Avenue N.W. and Legacy Park Drive is included in the City's Capital Improvement Program as one of several University North Park Tax Increment Financing (TIF) projects. On May 8, 2012, City Council approved Development Agreement No. 5 for the UNP TIF District. Development Agreement No. 5 programmed funding for the construction of Legacy Park and the 24th Avenue NW and Legacy Park Drive Intersection Improvement Project.
On August 11, 2009, City Council approved Contract No. K-0910-48 with SMC Consulting Engineers, P.C. (SMC) for the design of both the intersection of 24th Avenue NW and Legacy Park Drive, and the intersection of 24th Avenue N.W. and Rock Creek Road, in the amount of $39,500. On August 14, 2012, City Council approved Contract No. K-1213-29 with CGC, LLC for the construction of the intersection of 24th Avenue NW and Legacy Park Drive, in the amount of $678,370.12.
