BACKGROUND:  City Council, at its meeting of December 10, 2013, approved the final plat and program of completion of public improvements for Greenleaf Trails Addition, Section 6, a Planned Unit Development generally located on the east side of 12th Avenue N.W. approximately ΒΌ mile south of West Tecumseh Road.  Also, City Council approved a deferral of street paving and sidewalk improvements in connection with 12th Avenue N.W.  The amount to be deferred was $99,986.70.
 
DISCUSSION:  An amendment to the required amount of cash surety has been submitted to the City Council at the request of the developer.  The initial deferral amount included street improvements and sidewalks along 12th Avenue N.W.  The developer has chosen to construct the sidewalks along 12th Avenue N.W. with the construction of Greenleaf Trails Addition Section 6.  Although unusual to request the public sidewalks be installed adjacent to a primary arterial street when the street paving improvements are deferred, staff is willing to take their request to City Council for the amendment to the amount of deferral required for the public improvements in connection with 12th Avenue N.W. It is staff's understanding that the sidewalks were part of their budget to install and not included in the developer's budget to be a part of the deferral funding.  It should be noted if the sidewalks are damaged at a later date it will be the responsibility of the developer/Home Owners Association to repair.
 
STAFF RECOMMENDATION:  Based upon the above information, Staff recommends that the amendment be approved and the developer submit a cash surety in the amount of $73,080.25.
