EASEMENT E-2021-24:  CONSIDERATION OF ACCEPTANCE OF A PUBLIC UTILITY EASEMENT DONATED BY CJM NORMAN, L.L.C., TO SERVE LOT 1, BLOCK 1, NORMANDY ACRES SECOND ADDITION.

BACKGROUNDThe property is located on the south side of West Main Street between 26th Ave. S.W. and 26th Drive S.W. at 2520 West Main Street.  The final plat for Normandy Acres Second Addition was filed of record on June 14, 1985, in Book 15, Page 90. Owners have expanded the retail building and at this time, the easement is in use. The former utility easements were closed by Ordinance O-1819-23 on January 22, 2019, vacated by District Court on March 12, 2019; Case CV-2019-270 and filed of record Book 5898, Pg. 1304-1326

 

DISCUSSION: The current utilities including sanitary sewer were relocated by construction plans submitted by SMC Consulting Engineers, P.C. The proposed easement will cover the operating relocated utilities which will continue to serve the platted properties in this addition. City Staff have reviewed the easements as to form.

 

RECOMMENDATION: Based upon the above information, it is the recommendation of staff that Easement E-2021-24 be approved and filed of record with the Cleveland County Clerk.
