BACKGROUND: Federal funds available under the Transportation Enhancement Program, which was created to broaden the federal focus from building highways to funding projects that help ensure communities are more livable, may be used for a maximum of eighty percent (80%) of the eligible project costs, capped at $600,000 per project. Successful applicants must agree to provide a minimum of twenty percent (20%) of the total project costs.

On September 9, 2014, the Oklahoma Department of Transportation, which administers the Enhancement Program, informed the City of Norman that its Legacy Trail Extension Project along 24th Avenue NW and 36th Avenue NW, was among the applying statewide projects selected for inclusion in their latest Transportation Enhancement Program plan. On July 30, 2015, Cabbiness Engineering LLC of Norman was selected to design the project, and developed a detailed scope of service and a related fee of $65,100 for the services, both of which the City and ODOT staffs reviewed and found acceptable.

On October 13, 2015, the City Council approved Contract K-1516-64 between the City of Norman and Cabbiness LLC, in the amount of $65,100 for the services associated with the design of the Legacy Trail Extension Project which would construct Legacy Trail in undeveloped segments along 24th Avenue NW and 36th Avenue NW. A pedestrian lighting element, to complete the existing lighting on the east side of 24th Avenue NW within the University North Park development, was part of the project scope, to be a further enhancement along that corridor.
