SPECIAL CLAIM SC-1617-4: SUBMITTED BY JUANITA M. HARRIS IN THE AMOUNT OF $3,612.57 FOR DAMAGES TO HER VEHICLE AS A RESULT OF AN ACCIDENT WITH A STREET MAINTENANCE VEHICLE AT THE INTERSECTION OF EAST LINDSEY STREET AND CLASSEN BOULEVARD.

BACKGROUND: A claim was filed by Juanita Harris for the cost of repairing damage that her vehicle received on February 17, 2017, when she states a City of Norman dump truck ran into the back of her vehicle while she was stopped at a red light on Lindsey Street and Classen Boulevard.
DISCUSSION: This incident was reviewed by Greg Hall, Street Superintendent, and it has been determined that a City employee was driving dump truck #102 and did run into Ms. Harris’ vehicle as indicated. The Traffic Collision Report states the employee was stopped behind Ms. Harris when the dump truck he was driving began to roll forward, striking her vehicle. A mechanical failure was indicated as the cause and the dump truck was towed from the site.
Ms. Harris submitted three (3) preliminary estimates for repair and the lowest estimate she provided is for $3,612.57. There may be an additional amount submitted at a later date for a rental car.
RECOMMENDATION: Based upon the above and foregoing, it is the recommendation of the City Attorney’s office that the claim of Juanita Harris, in the amount of $3,612.57, as set forth above, be approved.
