EASEMENT NO. E-1213-22: CONSIDERATION OF ACCEPTANCE OF A TEMPORARY EASEMENT DONATED BY UTC II, L.L.C., FOR THE LEGACY PARK CONSTRUCTION PROJECT.

BACKGROUND: The City Council approved Contract No. K-1213-67 with CGC, LLC on January 22, 2013, for the construction of Legacy Park. CGC has requested space to set up the construction trailer and store materials as needed throughout the 12 to 14 month construction timeframe. The proposed restaurant pad on the north side of the Park was identified as the best location for the storage and staging area. This area is owned by UTC II, LLC (the "Developer"). The Developer has agreed to donate the temporary construction easement for the estimated duration of the park construction project.
RECOMMENDATION: Staff recommends acceptance of Temporary Easement No. E-1213-22 from UTC II, LLC.
