BACKGROUND:  The final plat for Fountain View North Addition, a Planned Unit Development was filed of record with the Cleveland County Clerk on February 5, 2014. The property consists of 16 acres and is generally located near the southeast corner of West Tecumseh Road and 48th Avenue N.W. The property is under construction. The Development Committee accepted public sanitary sewer and water improvements on February 3, 2014. These improvements are contained within existing platted utility easements. However, after the final plat was filed of record the developer was informed by the franchise utility companies that additional utility easements are needed for their facilities. The owner/developer determined it would be best to file the additional easements through the City in order to provide public utility easements for all of the franchise utility companies.
 
DISCUSSION:  The owner/developer is donating the public utility easement and will pay for the filing of the easement.  Staff recommends the acceptance of the easement as submitted.
 
RECOMMENDATION:  Staff recommends that Easement No. E-1415-18 be accepted and the filing thereof be directed.
