BACKGROUND: Nextel West Corporation is under order from the Federal Communications Commission (FCC) to stop interference within the 800 MHz radio band. This process is being funded entirely by Nextel West Corporation. Contract No. K-0809-45 was approved by City Council on December 23, 2008, and was executed by Nextel West Corporation on January 21, 2009. Since execution of the Contract, City staff and contractors deployed various radios to both internal City users and external users that operate under our FCC license(s). The First Amendment to the Contract was approved by City Council on August 25, 2009, which added 25 additional replacement radios along with labor and materials. On September 13, 2011, City Council approved the Second Amendment to the Contract which added 151 additional replacement radios, the tuning of a mutual aid repeater and additional labor and materials. On March 12, 2013, City Council approved the Third Amendment to the Contract which replaced the mutual aid repeater. This Fourth Amendment to the Contract is for Professional Services Costs for additional project management.

DESCRIPTION: Nextel West Corporation is obligated by the FCC to pay for professional services costs. Nextel West Corporation and the City have negotiated the costs of the professional services costs for additional project management in the amount of $7,875, none of which is a cost to the City of Norman. After the work is completed, and the City gives final approval, the $7,875 will be paid directly from Sprint Nextel.

RECOMMENDATION: Staff recommends approval of the Fourth Amendment to Frequency Reconfiguration Agreement Contract No. K-0809-45.
