Body

BACKGROUND:  This is a request for closing a portion of an existing platted utility easement within Lot 14, Block 2, Las Colinas Addition, Section 2 (4200 Las Colinas Lane).  The final plat for Las Colinas Addition, Section 2 was filed of record on June 7, 2012.  City Council, at its meeting of October 25, 2016 approved Consent to Encroach No. 1617-1.  However, the owners desire not to have a cloud on the title and desire to partially close and vacate the easement where a proposed swimming pool will be installed.

 

DISCUSSION:  All franchised utilities were notified to assess the impact on their facilities with the partial closure of the easement; there were no objections subject to the relocation of an existing retaining wall and Oklahoma Electric Cooperative (OEC) electrical cable, at the expense of the owner.  Currently, there are no City owned utilities or additional utility companies located within the easement.  This will allow the property owners to utilize seven and half feet for a proposed swimming pool.  Planning Commission, at its meeting of March 9, 2017, recommended adoption.

 

RECOMMENDATION:  Based on the fact the remaining seven and a half-foot (7.5’) utility easement will provide sufficient width for an OEC utility, staff can support the request to close a portion of the utility easement as described in the document.
