BACKGROUNDA claim was filed by Dennis Bloye in the amount of $2,182.96, for damage to his 2004 Chevrolet Silverado pick-up truck when it was struck by a City of Norman sanitation vehicle in front of his home on 3708 Astor Drive.

 

DISCUSSIONAs part of the investigation, Mr. Bloye provided the City with a security video recording of the incident that occurred on May 15, 2017.  The video begins by showing a City sanitation vehicle emptying one of two polycarts in front of Mr. Bloye’s home with Mr. Bloye’s truck parked against the curb several feet ahead.  The sanitation vehicle is then seen slowly moving forward when it strikes the rear of the truck, reverses several feet and then comes to a complete stop, at which point the City employee gets out of the vehicle and inspects the rear of the truck.

 

Mr. Bloye has submitted three (3) estimates to repair the left rear side panel, bumper and tailgate of his truck and the lowest estimate is for $2,182.96. As indicated above, there appears to be possible negligence on the part of the City in this matter and, consequently, potential liability on the City.  Mr. Bloye’s request, in the amount of $2,182.96, appears reasonable.

 

RECOMMENDATIONBased upon the above and foregoing, it is the recommendation of the City Attorney’s office that the claim of Dennis Bloye in the amount of $2,182.96 as set forth above be approved.
