CONSIDERATION OF ACCEPTANCE OF A CORRECTED WARRANTY DEED FROM HIGHLAND HILLS, L.L.C., FOR PARK LAND SERVING THE HIGHLAND VILLAGE NEIGHBORHOOD.

BACKGROUND: The Norman City Council, on October 9, 2007, accepted a deed from Highland Hills, LLC for 8.18 acres, more or less, for dedication as a city park serving the Highland Village neighborhood. That deed and legal description are attached.
City Staff and Highland Hills, LLC have discovered that the final plat for Highland Hills Addition and the deed for the parkland have an area of overlap. A copy of the final plat is attached that depicts the area of overlap. In order to remove that area of overlap, Highland Hills LLC has submitted a corrected deed for City Council's review and acceptance.
DISCUSSION: The corrected deed and legal description are attached. The overlapping portion was located on the east side of the proposed park. Highland Hills, LLC has removed that overlapping portion from the legal description and swapped it for the same amount of land along the north side of the park property. In this way, the City of Norman retains the same amount of land for the park, and the developer does not have to amend his final plat or interfere with the occupied lots and platted street that were included in the overlap area.
RECOMMENDATION: If accepted by City Council, the attached corrected deed will replace the current deed and be filed of record with the Cleveland County Clerk's Office. Staff recommends acceptance of the corrected deed in order to remedy the area of overlap of the parkland and the final plat for Highland Village Addition.
