SPECIAL CLAIM NO. SC-1314-2: A CLAIM IN THE AMOUNT OF $2,488.88 FROM CMR CLAIMS MANAGEMENT RESOURCES ON BEHALF OF OKLAHOMA GAS AND ELECTRIC COMPANY FOR DAMAGES INCURRED TO A PRIMARY LINE WHILE CITY EMPLOYEES WHERE INSTALLING A FENCE AT GRIFFIN PARK LOCATED AT 1001 EAST ROBINSON STREET.

BACKGROUND: A claim has been filed by O G & E for damages to a primary line located at 1001 Robinson Avenue on December 19, 2012 in the amount of $2,488.88. O G & E alleges that City employees were installing a fence at Griffin Park and while digging in preparation to installing the fence, hit the O G & E line.
DISCUSSION: This incident was investigated by Bill Ulch, Parks and Recreation Superintendent. According to his investigation, Park Maintenance staff was installing a fence at the new dog park at Griffin Park on December 19, 2012. . While digging holes for the posts, crews came in contact with an electrical line that connected to the trail lights. Before any digging was done, OKIE Spot had been contacted to locate all utilities within the project area and all lines were properly flagged. At the time of the incident, Parks and Recreation staff contacted O G & E and reported the incident.
As indicated above, there appears to be possible negligence on the part of the City in this matter and, consequently, potential liability on the City. The amount claimed by O G & E appears to be reasonable.
RECOMMENDATION: Based upon the above and foregoing, it is the recommendation of the City Attorney's Office that the claim by O G & E for damage to their primary line at 1001 Robinson Avenue in the amount of $2,488.88, as above set forth, be approved.
