CONSIDERATION OF AN AMENDMENT TO THE APPROVED SITE PLAN SO AS TO ALLOW A SEASONAL SNOW CONE STAND FOR ROGER COX TO BE LOCATED AT 401 SOUTH PORTER AVENUE.

SYNOPSIS: This commercially zoned lot is platted and has had various uses on the site over the years. Currently, the site is home to a food vendor trailer. The applicant is seeking approval to temporarily locate a snow cone stand on the southwest corner of the lot.
ANALYSIS: Staff presented this proposal in 2012 to be located at the corner of East Lindsey Street and 24th Avenue SE. The applicant has the opportunity to relocate the existing unit to an area of town with higher vehicular and pedestrian traffic volume. The unit is a mobile trailer, and the applicant stated he will skirt the unit and possibly build a picnic area around the hitch for customers to use while eating snow cones. The applicant stated that throughout the summer he would occasionally remove the unit from the site to attend special events and return to the same location. The City requires that all temporary facilities/buildings be removed from the site after a 180 day period, and the applicant is aware of and has agreed to this condition. Employees and customers have permission to use the restroom facilities in the building located on the northeast corner of the lot.
APPEARANCE: The City has adopted a requirement that new commercial buildings, including some accessory buildings, be constructed of masonry materials. This structure is a mobile/temporary snow cone stand, and would be exempt from that requirement.
LOCATION: The proposed location of the unit is at the front of the lot, adjacent to Porter Avenue. The unit will not be blocking visibility of any other businesses.
PARKING: The site is fully paved, there is parking to the north and east of the facility, and the applicant hopes to get foot traffic from adjacent neighborhoods.
