CONSIDERATION OF ORDINANCE O-1920-43 UPON SECOND AND FINAL READING:  AN ORDINANCE OF THE COUNCIL OF THE CITY OF NORMAN, OKLAHOMA, CLOSING A PLATTED PEDESTRIAN EASEMENT SITUATED IN THE NORTHEAST QUARTER (NE/4) OF SECTION TEN (10), TOWNSHIP NINE (9) NORTH, RANGE THREE (3) WEST OF THE INDIAN MERIDIAN, TO NORMAN, CLEVELAND COUNTY, OKLAHOMA; AND PROVIDING FOR THE SEVERABILITY THEREOF.

 

Body

BACKGROUND:  The final plat for Carrington Place Addition, Section 5 was filed of record with the Cleveland County Clerk on August 26, 2005, in Book 20, Pages 163 and 164.  The owners are requesting closing and vacating a platted 47.18-foot pedestrian easement located on the west boundary of Lots 23 and 24, Block 1.  This request does not include a 10’ utility easement located on the west boundary of subject lots.  As a result, the utility companies were not notified of the request.

 

DISCUSSION:  The 47.18-foot pedestrian easement was not a requirement the City of Norman.  Apparently at the time of platting, the developer anticipated a need for the easement.  A sidewalk has been provided in the common area west of the properties and the easement is no longer needed. 

 

Planning Commission, at its meeting of March 12, 2020, recommended adoption by a vote of 6-0.

 

RECOMMENDATION:  Staff recommends approval of this request to close a 47.18’ platted pedestrian easement located on the western boundary of Lot 23 and Lot 24, Block 1, Carrington Place Addition, Section 5 that interferes with plans for a swimming pool or accessory structures.
