BACKGROUNDThe final plat for Millennium Addition PUD was filed of record with the Cleveland County Clerk on May 7, 2015. The property is approximately 6.86 acres and consists of 1 multifamily lot which is located just south of Lindsey Street and east of Classen Blvd. The property owners have submitted easement E-1516-32 for utilities (sanitary sewer) and E-1516-33 for a drainage structure located on the referenced platted area for Millennium Addition.

 

DISCUSSIONSanitary sewer and drainage improvements were installed as part of the Millennium Addition, PUD development.  After the final plat was filed of record the surveyor discovered these utilities were located outside the platted easements.  As a result, additional separate instruments were needed to cover the above mentioned utilities.  The easements have been donated by the owners.  The Legal Department has reviewed both easements as to form.

 

RECOMMENDATIONBased upon the above information, it is the recommendation of staff that Easement. E-1516-33 be utilized for drainage be approved.
