CONSIDERATION OF ORDINANCE O-1920-53 UPON SECOND AND FINAL READING: AN ORDINANCE OF THE COUNCIL OF THE CITY OF NORMAN, OKLAHOMA, CLOSING UTILITY EASEMENTS LOCATED IN REPLAT OF THE EAST 286 FEET OF LOT SIX (6) AND THE EAST 200 FEET OF LOT SEVEN (7), OF ELMWOOD ADDITION, TO THE CITY OF NORMAN, CLEVELAND COUNTY, OKLAHOMA; AND PROVIDING FOR THE SEVERABILITY THEREOF. BACKGROUND: This is a request from a private property owner for closing easements dedicated to Oklahoma Gas & Electric Company and Cox Communications. The easements were filed of record with the Cleveland County Clerk in September of 1972, October of 1972, January of 2006 and October of 2010.
DISCUSSION: The easements filed as separate instruments are not dedicated to the City of Norman. Instead, the easements are dedicated to specific franchise utility operators in Norman. Based on the fact the existing structures served by the utilities have been demolished, there is no longer the need of the utilities and easements.
Planning Commission, at its meeting of May 14, 2020, recommended adoption by a vote of 8-0.
RECOMMENDATION: The easements in question were specifically designed to serve the apartment buildings. Since the apartments are no longer existing, staff supports the closure of the various easements described in the applicant’s request.
