BACKGROUND: This item is a final plat for Independence Valley Addition, Section 1, and is generally located one-quarter mile west of 12th Avenue S.E. on the south side of Cedar Lane.

City Council, at its meeting of February 28, 2006, adopted Ordinance No. O-0506-26, placing this property in the R-1, Single Family Dwelling District and removing it from A-2, Rural Agricultural District. City Council, at its meeting of June 12, 2012, approved the preliminary plat for Independence Valley Addition. Planning Commission, at its meeting of June 14, 2012, approved the final plat for Independence Valley Addition, Section 1.

DISCUSSION: This final plat consists of 10.79 acres with 43 single family residential lots. Currently, these are the only lots that have been designed with a gravity sanitary sewer system.

Construction plans have been reviewed for the required public improvements for this property. These improvements consist of water mains with fire hydrants, sanitary sewer mains, paving, drainage and sidewalks. A private park is proposed for this development. Covenants have been submitted for staff's review and approval as to form. Corrections have been made by the developers and City Legal staff has approved them as to form.

STAFF RECOMMENDATIONS: The final plat is consistent with the preliminary plat except for the removal of a ten (10) acre tract located to the west which was recently acquired by the Shaz Investment Groups, Inc. The ten (10) acre tract is not included with the final plat of Section 1. The developer has not yet indicated the intentions for the ten (10) acre parcel.
