BACKGROUND:  The applicant has requested closure of the designated drainage easement within the above stated development. The final plat for University North Park Addition, Section VI, a Planned Unit Development was filed of record with the Cleveland County Clerk on October 5, 2009.  The easement is located within Lots 5 and 6, Block 1.  Planning Commission, at its meeting of January 14, 2016, recommended closure of a part of the 20’ drainage easement as described in the ordinance.

 

DISCUSSION:  The applicant has submitted a request to close and vacate a portion of a 20’ drainage easement.  Franchised utilities were not notified since this is an exclusive drainage easement. With the original design of the lots, the existing storm sewer was installed to serve the proposed parking lots within Lots 5 and 6.  The new owners have purchased both Lots 5 and 6, Block 1.  With the creation of one large lot, a portion of the storm sewer is no longer needed and will be abandoned.  With the new proposal, a portion of the building would have been located within the platted drainage easement.  The owners hired a professional engineer to submit plans for the termination of the storm sewer.

 

RECOMMENDATION:  Staff recommends approval of the request to close a portion of a platted 20’ drainage easement located within Lots 5 and 6, Block 1, University North Park Addition, Section VI, a Planned Unit Development.
