SPECIAL CLAIM NO. SC-1415-2: A CLAIM IN THE AMOUNT OF $2,371.56 AND RENTAL CAR EXPENSES SUBMITTED BY NATALIE CARNS FOR DAMAGES TO HER VEHICLE DUE TO AN ACCIDENT WITH A STREET MAINTENANCE VEHICLE AT 530 EAST MAIN STREET.

BACKGROUND: A claim has been filed by Natalie Carns for damage to her parked vehicle when a City vehicle struck her car while driving through a parking lot on May 22, 2014 at 530 East Main Street. The estimate to repair Ms. Carns' vehicle is $2,371.56. Additionally, rental car expenses will be incurred while her vehicle is being repaired.
DISCUSSION: This incident was investigated by Greg Hall, Street Superintendent. According to his investigation, a City vehicle driven by David Robinett was driving in the parking lot at the Sarkey's Foundation on May 22, 2014. Mr. Robinett was attending a City function. Ms. Carns' vehicle was parked in the Sarkey's Foundation parking lot and while Mr. Robinett was driving through the lot, he sideswiped Ms. Carns' vehicle which damaged the mirror and driver's side of her vehicle.
There appears to be possible negligence on the part of the City in this matter and consequently, potential liability on the City. The estimate for the body damage repair of Ms. Carns' vehicle appears reasonable. Ms. Carns will require the use of a rental car while her car is being repaired and will use the City's direct pay account with Enterprise for the rental.
RECOMMENDATION: Based upon the above, it is recommended by the City Attorney's Office that the claim of Natalie Carns in the amount of $2,371.56 for repair of her car plus rental car expense be approved by Council.
