EASEMENT E-1617-23: CONSIDERATION OF ACCEPTANCE OF A SIDEWALK EASEMENT DONATED BY CHASE HOMES, LTD., FOR LOT 2, BLOCK 5, ST. JAMES PARK, SECTION 3, A/K/A: 2505 LANGLEY COURT.

BACKGROUND: The final plat for St. James Park, Section 3 was approved by City Council on March 10, 2005 and was filed of record on March 11, 2005 with the Cleveland County Clerk. The plat consists of 47 residential lots located just east of 24th Ave S.E. and north of Cedar Lane. The property owners have donated easements for a public sidewalk located outside of the right-of-way of Langley Court.
DISCUSSION: Public sidewalk improvements have been installed as part of the home construction. To meet the sidewalk width requirements, a portion of the public sidewalk was placed on private property. The City Attorney’s Office has reviewed the easement as to form.
RECOMMENDATION: Based upon the above information, it is the recommendation of staff that Easement E-1617-23 for a public sidewalk be accepted.
