Title

SPECIAL CLAIM SC-1718-14:  SUBMITTED BY CAMPUS LODGE APARTMENTS IN THE AMOUNT OF $2,649.19 FOR DAMAGES TO THEIR TRASH COMPACTOR WHILE BEING COLLECTED BY A CITY SANITATION EMPLOYEE AT 1800 BEAUMONT DRIVE.

Body

BACKGROUNDA claim was filed by Campus Lodge Apartments in the amount of $2,649.19 for damage to the electrical system of an industrial trash compactor that occurred when it was being serviced by City Sanitation at 1800 Beaumont Drive.

DISCUSSIONThis incident was investigated by Casey Sides, Utilities Supervisor.  On October 16, 2017, a City Sanitation Division employee was servicing an industrial, roll-off trash compactor owned by Campus Lodge Apartments located at 1800 Beaumont Drive.  As the employee began loading the compactor onto the sanitation truck, he forgot to disconnect the hydraulic lines from the compactor.  This caused the lines to be pulled from their power source in a manner not intended, subsequently damaging the power source located at the property.

Campus Lodge Apartments submitted a service invoice in the amount of $2,649.19 which was the cost to repair the damaged electrical components that power their roll-off trash compactor unit.  As indicated above, there appears to be possible negligence on the part of the City in this matter and consequently potential liability on the City.  Campus Lodge Apartments’ claim, in the amount of $2,649.19, appears reasonable.

RECOMMENDATIONBased upon the above and foregoing, it is the recommendation of the City Attorney’s office that the claim of Campus Lodge Apartments, in the amount of $2,649.19 as set forth above, be approved.
