CONSIDERATION OF ACCEPTANCE OF EASEMENT NO. E-1213-12, A PERMANENT PARKLAND EASEMENT, DONATED BY UTC II, L.L.C., FOR THE LEGACY PARK PROJECT.

BACKGROUND: The final plat for University North Park Section IX was approved by City Council on July 24, 2012. This plat included parkland for Legacy Park. During Staff review of the Legacy Park plans, it was discovered that a small portion of land (.0074 acres) that had been included in Scott Howard's Legacy Park design in 2007/2008 was inadvertently excluded from the parkland designated on the final plat.
DISCUSSION: UTC II agreed to donate a permanent public parkland easement to address this issue. This easement will allow the park design as it relates to this small portion of land to go forward as originally envisioned.
RECOMMENDATION: Staff recommends acceptance of donated easement E-1213-12, a permanent public parkland easement, from UTC II.
