CONSIDERATION OF APPROVAL OF CERTIFICATE OF PLAT CORRECTION CPC-1617-3 FOR LOT 1, BLOCK 1, EASTPARK CROSSING SECTION II, A PLANNED UNIT DEVELOPMENT.

 

Body

BACKGROUND:  The final plat for Eastpark Crossing Section II, Lot 1, Block 1, was filed of record September 12, 2016 with the Cleveland County Clerk in Book 24 of Plats, Pages 172 and 173.  Since that time, it has been determined that certain scrivener's or draftsman’s errors have been found within the plat.  Title 11.0S, 1981, §41-115 permits or provides a method of amending or correcting final plats; subject to the governing body of a City approving such changes.

 

DISCUSSION:  The specific errors relate to a north boundary bearing of the plat. It impacts only this plat.

 

RECOMMENDATION:  Staff is not opposed to the changes, and since a procedure has been established without the requirement for District Court action, Staff recommends City Council approval of Certificate of Plat Correction No. CPC-1617-3 for Eastpark Crossing Section II, a Planned Unit Development.
