CONSIDERATION OF ORDINANCE O-1516-16 UPON SECOND AND FINAL READING:  AN ORDINANCE OF THE COUNCIL OF THE CITY OF NORMAN, OKLAHOMA, CLOSING A PORTION OF THE PUBLIC RIGHT-OF-WAY LOCATED ADJACENT TO LOTS 27, 28, 29 AND 30, BLOCK FIVE (5), NORMAN HEIGHTS ADDITION TO NORMAN, CLEVELAND COUNTY, OKLAHOMA; AND PROVIDING FOR THE SEVERABILITY THEREOF.

BACKGROUND:  Norman Heights Addition plat was filed of record on April 19, 1921, with sixty-feet (60’) of right-of-way for Iowa Street located south of 702 North Lahoma Avenue.  The applicant, Greenwave L.L.C. is interested in closing and vacating the north five feet (5’) of the Iowa Street right-of-way due to the encroachment of an existing house constructed in the 1930’s.  Upon researching this area, most of the utilities are located to the north of the property.  A City owned water main is located on the south side of Iowa Street.

 

DISCUSSION:  If this property were platted under the current Subdivision Regulations and Engineering Design Criteria, the required right-of-way for Iowa Street would be fifty-feet (50’) wide.  Staff, in considering this item, focused on the fact that Iowa Street is not proposed to be physically closed or eliminated.  There would still be adequate right-of-way if sidewalks were proposed for this area or any upgrade in street improvements.  There were no objections by the utility companies for the five-foot closure of the public right-of-way.

 

RECOMMENDATION:  Staff recommends approval of the request to close the north five feet (5’) of a sixty foot (60’) right-of-way adjacent to Lots 27 through 30, Block 5, Norman Heights Addition.
