SPECIAL CLAIM SC-1617-7: SUBMITTED BY PATRIOT FORD IN THE AMENDED AMOUNT OF $2,359.62 FOR DAMAGES TO THEIR VEHICLE AS A RESULT OF AN ACCIDENT WITH A BACKHOE AT THE CITY TRANSFER STATION LOCATED AT 3901 SOUTH CHAUTAUQUA AVENUE.

BACKGROUND: A claim was filed by Patriot Ford in the amount of $2,587.88 for the cost of repairing damage their vehicle received on April 15, 2017, when an authorized driver of their vehicle was parked at the City Transfer Station and was struck by a backhoe operated by a City employee.
DISCUSSION: This incident was investigated by Greg Hall, Street Superintendent, and it has been determined that on April 15, 2017, Patriot Ford’s vehicle was parked facing east inside the Transfer Station’s main unloading building when a City employee operating a backhoe attempted to drive west past the vehicle. As the backhoe approached, its right rear outrigger was partially down and subsequently collided with the right front side of the other vehicle, causing damage to it.
Patriot Ford submitted a preliminary estimate from their contracted repair shop for $2,587.88 but later amended their claim for $2,359.62, the actual amount for repair.
RECOMMENDATION: Based upon the above and foregoing, it is the recommendation of the City Attorney’s office that the claim of Patriot Ford, in the amended amount of $2,359.62 as set forth above, be approved.
